Lilly alleges the “research use only” label was a pretext: that the sellers supplied dosing instructions, ran consumer-facing storefronts without prescriptions, and served buyers who intended to inject the compound themselves. Retatrutide is still in Phase 3 and is not approved by any regulator anywhere in the world.
The critical detail is the legal framing. There are no patent claims and no trademark claims in any of the six. Lilly pleaded state consumer-protection statutes — Alaska, Colorado, Connecticut, North Carolina, South Carolina, Tennessee and Washington, plus Texas common law. The RUO disclaimer isn’t being treated as a defence. It’s being treated as the misrepresentation.
These are allegations. No defendant has been found liable, and as of this update none has filed a public denial.
